Application for Roads Act 1993 consent at 7 Pretoria Avenue

Council has received an application from the owner of 7 Pretoria Avenue, Mosman to formalise existing encroachments on the Pretoria Avenue road reserve adjacent 5 and 7 Pretoria Avenue comprising a suspended car parking platform and associated structures under sections 138/140 of the Roads Act 1993.
The encroachments have been in place since 1975 and have historically been formalised under the Local Government Act 1919 and more recently as a “temporary” structure under section 153 of the Roads Act 1993 by way of a lease which needs to be renewed every five years. The last lease on this site has now expired and as Council will no longer consent to section 153 leases for structures which are not considered as temporary, it is proposed grant a one-off consent under sections 138/140 of the Roads Act 1993 to 7 Pretoria Avenue to formalise the encroachment. The terms and conditions of agreements granted by Council under section 153 and sections 138/140 are essentially the same, including the provision for Council to require removal of the structures from its land at any time.
