Proposed road closing under Section 38B of the Roads Act 1993 – Musgrave Street

Consultation has concluded
Mosman Municipal Council is proposing to close a Council public road for the purpose of open space. The Council public road proposed for closure is a portion of Musgrave Street (adjoining 1 Musgrave Street - Lot 1 DP1249538) and known as Little Curraghbeena Reserve.
Council intends to keep the road vested in Council upon closure as per Section 38E of the Roads Act 1993. Upon closure of the road Council then intends to formalise its use as a public open space by reclassifying the land as community land pursuant of Clause 33 of the Local Government Act 1993.
It is important to note that this proposal is the same proposal as that notified in 2014 and approved in principle by Crown Lands in May 2017 - Crown Lands Ref: 10/00585 Account No: W491527. Due to delays in establishing the high water mark for the proposed road closure, together with the introduction of the Crown Lands Management Act 2016 on 1 July 2018 and amendments to the Roads Act 1993, Council was unable to complete the road closure process and is now required to recommence the process.
The area of Musgrave Street proposed to be closed is displayed by black fill labelled ‘W491527’ on the accompanying diagram and as described in the accompanying notification published in the Mosman Daily on 27 February 2020.
