Road Reserves Sale, Lease and Consent Policy

Consultation has concluded

Council at its meeting on 7 April 2020 considered a report on a proposal to adopt a policy on when and how Council will consider applications for the closure and sale of, leasing of or consent to occupy road reserves.

It is proposed that the draft policy replace Council's existing policy relating to the lease and sale of its road reserves which was adopted in June 2000. The existing policy has been reviewed as it is limited in its scope and relays an unclear message on when Council would actually support a merit based application.

The draft policy clarifies Council's position and aligns with current issues and practices in assessing applications to either close and purchase or occupy Council’s unformed road reserves. It makes it abundantly clear that no application will be considered unless a proposal meets general and overarching principles and are:

  • consistent with Council’s economic, social and environmental objectives undertaken in compliance with legislative and other obligations
  • only granted following consultation with all affected stakeholders and relevant sections of the community taking into account all relevant comments and submissions
  • granted with the intention of securing maximum financial and other benefits for the community
  • subject to fair and open process and include regular market testing
  • open to public scrutiny while maintaining appropriate levels of commercial confidentiality
  • in accordance with government agency and ICAC guidelines
