Consultation has concluded

In late December 2023, the NSW Government released proposed changes to the planning system that are intended to increase the capacity for low and mid-rise housing in well-located areas near existing services and infrastructure. The changes are on exhibition for public comment until Friday 23 February 2024.

The Explanation of Intended Effect: Changes to create low and mid-rise housing outlines significant changes to planning controls that would substantially increase the development capacity of land located within proximity of a “station or town centre precinct”.

A “station or town centre precinct” is a new term being introduced under the reforms and is proposed to include land within 800m walking distance of land zoned E1 Local Centre but only if the zone contains a wide range of frequently needed goods and services such as full line supermarkets, shops and restaurants.

Key changes:

  • Allow terraces, townhouses and 2 storey apartment blocks in R2 Low Density Residential zones within station and town centre precincts.
  • Allow residential flat buildings up to 21 metres in height on land within the inner part of the station and town centre precinct including land that is zoned R3 Medium Density Residential.
  • Allow residential flat buildings up to 16 metres in height on land zoned R3 Medium Density Residential within the outer part of the station and town centre precinct.

The reforms also include allowing two dwellings on the same lot (dual occupancies) in all R2 Low Density Residential zones across NSW.

To facilitate and encourage these developments, the NSW Government propose to set non-refusal standards that will override councils' own planning controls unless the equivalent local environmental plan or development control plan standard is more permissive.

Council staff are currently reviewing the exhibition package to report to the Council in February 2024.
