Application for Roads Act 1993 Consent at 1A Bapaume Road

Council has received an application from the owners of 1A Bapaume Road, Mosman to formalise an existing minor encroachment and the proposed modification of the encroachment on the road reserve pathway to the north of 1A Bapaume Road and running between Mitchell Lane and Bapaume Road under sections 138 - 140 of the Roads Act 1993.
A garage was constructed at 1A Bapaume Road in the 1970s by previous owners however it encroached upon the pathway by 460mm for the length of the garage (5045mm). There is no record of an approval for the encroachment of the garage. The proposal involves the renovation of the garage on a similar footprint of the current structure being approximately 2.5m2. Due to space constraints at the frontage of this property it is not practical to demolish the structure and reconstruct wholly within the private property. Accordingly, Council is considering an application for a modified encroachment to remain and be formalised under the Roads Act 1993. The location of the property is shown on the aerial image and detail of the proposal is shown on the plan – the 2.5m2 encroachment is highlighted and circled red on the plan.
The granting of a Roads Act 1993 consent for an encroachment to remain on the pathway is a prerequisite to the owners lodging a development application to renovate the garage utilising a similar footprint of the existing garage.
Submissions regarding the application for the Roads Act 1993 consent will close Thursday 15 December 2016.
