Why is Council proposing to amend the Residential Development Control Plan?
Council is proposing to amend the Residential DCP to ensure that new housing developments utilising the LMR provisions are designed to respond to Mosman's unique local character and minimise impacts on existing developments, heritage buildings and heritage conservation areas, have a high quality design and provide appropriate streetscapes, landscaping and tree canopy cover and waste collection facilities.
The amendments are intended to be an interim measure to help protect Mosman's character while the Mosman Masterplan planning controls are being developed.
When did Council resolve to publicly exhibit the proposed changes?
Council resolved to publicly exhibit proposed amendments to the Residential DCP on 5 May 2026, where a report - EP/14 - Development Control Plan - Low to Mid-Rise Update was considered.

What changes are proposed to be made?
Council is proposing to amend Section 5.5 Medium Density Housing, insert Section 5.5B Design Criteria for Low and Mid-Rise Housing Areas and amend Section 5.10 Transport, access and parking.

What is the legislative process to amend a DCP?
NSW planning legislation pertaining to Development Control Plans (DCP) is contained within Part 3, Division 3.6 of the Environmental Planning and Assessment Act 1979 and Part 2 Division 2 of the Environmental Planning and Assessment Regulation 2021.

Yes, submissions are invited and should be emailed to - council@mosman.nsw.gov.au
Submissions close on 16 June 2026
All submissions will be available for inspection on Council’s document management system and website under Council’s Access to Information Policy.
What are the next steps?
Following the public exhibition, any submission received will be considered and the draft amendments reviewed. A report will then be prepared for a Council meeting seeking adoption of the DCP amendments. If adopted, the changes would come into effect when published on the Council website.
